Terms and conditions for purchasing electronic gift coupons

General provisions

These Electronic Gift Coupons Purchase Terms and Conditions (hereinafter referred to as the Rules) constitute an agreement between K. Geco Trading Company, legal entity code 152621575, VAT number LT526215716, registered office address Birutės al. 60, LT-00136 Palanga (hereinafter referred to as the Seller) and You, pursuant to which the Seller will provide You with the opportunity to purchase gift coupons (hereinafter referred to as Gift Coupons) of the restaurant "Vandenis", located at Birutės al. 47, LT-00136 Palanga (hereinafter referred to as the Restaurant) and/or to use Gift Coupons at the Restaurant.

By purchasing a Gift Coupons, you agree to these Rules. The Buyer, having purchased a Gift Coupon and subsequently transferring it to another person, undertakes to inform that person about these Rules.

You are entitled to purchase a Gift Coupon only if you are legally able to form a binding contract with the Seller, and only if you comply with these Terms and Conditions and applicable laws. If you are under 18 years of age, you may purchase a Gift Coupon only with the consent of your parents or other legal representatives. By purchasing a Gift Coupon, you confirm that you are 18 years of age or older or have the consent of your parents or other legal representatives.

If the Gift Coupon is not intended for consumption purposes and you purchase it for purposes related to your (existing or planned) business, trade, craft or profession, the requirements of the consumer protection legislation will not apply to you. The provisions of these Terms, which are intended for consumers, will apply only if you purchase the Gift Coupon as a consumer.

Purchase a gift coupon

When purchasing a Gift Coupon, you must enter the necessary details for its preparation and delivery. Please ensure that the details provided are correct. You have the opportunity to correct any errors, if any, before confirming the Gift Coupon order.

By ordering a Gift Coupon, you undertake to pay the Seller the price of the Gift Coupon. Prices are indicated in Euros.

You can pay using Wix Payments (bank card), Google Pay, Apple Pay. Payment must be made immediately after placing the Gift Coupon order.

After paying the price of the Gift Coupon, the Gift Coupon will be sent to the e-mail address you provided (to you or another recipient of the Gift Coupon). If you have selected a later date and time for the Gift Coupon delivery, the Gift Coupon will be sent to the recipient at the time you selected.

Gift coupon validity and use

Gift coupon validity

The Gift Coupon is valid for 12 months, unless otherwise stated on it. The recipient of the Gift Coupon must use the Gift Coupon in the Restaurant, i.e. pay for the Restaurant services with the Gift Coupon, within the period specified in the Gift Coupon. If the Gift Voucher is not used within the period specified in it, the specified period is not extended, the Gift Coupon becomes invalid, and the money paid for the Gift Coupon is not refunded.

Invalid or lost Gift Coupons are not refundable.

Using a gift coupon at a restaurant

The Gift Coupon is valid only after making a reservation for a table at the Restaurant. Reservations are made by phone +370 613 55551 or by e-mail manager@vandenis.lt. Restaurant reservations are accepted subject to availability.

To use a Gift Coupon, please inform the Restaurant staff in advance about paying with a Gift Coupon.

When submitting a Gift Coupon, it is necessary to indicate the unique code and expiration date of the Gift Coupon. You will find this information in the email sent with the Gift Coupon.

Gift Coupons cannot be exchanged for cash. If the full value of the Gift Coupon is not used, the remaining amount of the Gift Coupon will not be refunded in cash. If the value of the Gift voucher is not sufficient for payment at the Restaurant, the difference will be paid by the payment methods used at the Restaurant.

Processing of personal data

For the purpose of selling and administering Gift Coupon, the Seller, as a data controller, processes personal data: name, surname, e-mail address of the Gift Coupon buyer and recipient, Gift Coupon value, date of sale and delivery, Gift Coupon number, expiration date. Legal basis for processing personal data: contract (with regard to the personal data of a natural person – the Gift Coupon buyer) or the Seller's legitimate interest in carrying out activities (with regard to the data of the Gift Coupon recipient or the buyer – a legal entity representative). Personal data storage period: until the expiration of the Gift Coupon or until the Gift Coupon is used.

Intellectual property

You understand and acknowledge that: (a) all intellectual property rights to the Gift Coupons and their individual parts; (b) all trademarks or other signs used to designate the Gift Coupons, the Restaurant, the Seller's activities; (c) all trademarks and logos, domain name, website used by the Seller; (d) all individual elements thereof, including texts, photographs, drawings and all materials, (e) the presentation, image and design of any page of the website and (f) all intellectual property rights therein belong exclusively to the Seller and/or other persons. You undertake not to copy, modify or otherwise use these intellectual property objects without the separate written consent of the Seller or other rights holder.

Possibility of withdrawal from the contract

If you purchase a Gift Coupon as a consumer (i.e. a natural person acting for purposes which are outside their trade, business, craft or profession (consumer purposes)), you have the right to withdraw from the contract within 14 (fourteen) calendar days from the date on which you received the Gift Coupon, provided that the Gift Coupon has not yet been used. When withdrawing from the contract, you must irreversibly delete the Gift Coupon and its data.

To exercise the right to withdraw from the contract, you must notify the Seller by e-mail within the specified period and attach proof of purchase of the Gift Coupon.

If you withdraw from the contract, the Seller undertakes to refund you all the money you paid for the Gift Coupon no later than 14 (fourteen) calendar days from the date you notified the Seller of your withdrawal by e-mail. The refund will be made using the same payment method you used to pay for the Gift Coupon.

After the expiration of the aforementioned 14 (fourteen) calendar day period, the Gift Coupon cannot be returned and the money for it is not refundable.

Responsibility

A person who has illegally used, copied or otherwise altered and/or falsified a Gift Coupon, or who has participated in the illegal use, copying or otherwise falsification of a Gift Coupon, shall be liable in accordance with the procedure established by the laws of the Republic of Lithuania.

Changes and termination

The Seller may change these Terms from time to time. The latest (current) version of the Terms will always be visible and accessible on the website. Before ordering and/or using a Gift Coupon, you must familiarize yourself with the then-current version of the Terms.

The Seller shall have the right to discontinue (discontinue) the operation of the website and/or the sale of Gift Coupon at any time. Such termination shall not affect the validity of Gift Coupon that are valid at that time and have not expired.

Other conditions

These Rules and the Gift Coupon purchase and sale agreement are concluded and must be interpreted in accordance with the laws of the Republic of Lithuania.

Any disputes, disagreements or claims arising from or related to these Rules or the Gift Coupon purchase and sale agreement, as well as issues of their violation, termination or validity, shall be resolved in the courts of the Republic of Lithuania in accordance with the procedure established by the laws of the Republic of Lithuania. The subject of out-of-court settlement of consumer disputes, which is competent to resolve consumer disputes arising from these Rules, is the State Consumer Rights Protection Service (address: A. All warnings or other notifications related to these Rules will be provided by e-mail (sent to the Seller - to the e-mail address specified at the beginning of the Rules, sent to you - to the e-mail address provided when ordering a Gift Coupon).

If any provision of these Rules is or becomes invalid in whole or in part, this shall not affect the validity of the remaining provisions.
